Defines and outlines requirements for neighborhood electric shuttles.
History
A neighborhood electric vehicle is defined as a self-propelled electrically powered motor vehicle to which all of the following apply: 1) is emission free; 2) has at least four wheels in contact with the ground; and 3) complies with the definition and standards for low-speed vehicles set forth in federal motor vehicle safety standards and the code of federal regulations (A.R.S. § 28-101).
Pursuant to A.R.S. § 28-966, a neighborhood electric vehicle must not be operated at a speed of more than 25 miles per hour (MPH). A neighborhood electric vehicle must not be driven on a highway that has a posted speed limit of more than 35 MPH, except for crossing a highway that has a posted speed limit of more than 35 MPH at an intersection. There must be a notice of the operational restrictions applying to the vehicle permanently attached to or painted on the vehicle in a location that is in clear view of the driver.
A vehicle for hire is defined as a taxi, livery vehicle or limousine. A vehicle for hire is prohibited from operating in Arizona unless the vehicle for hire company is issued a permit by the Arizona Department of Transportation (ADOT). The permit is valid for three years. ADOT is required to revoke a permit if the vehicle for hire company fails to maintain the requirements for either: 1) motor vehicle licensing; and 2) motor vehicle insurance requirements. (A.R.S. § 28-9501, 28-9503).
Provisions
1. Defines neighborhood electric shuttle as a self-propelled electrically powered motor vehicle that:
a) Is emission free;
b) Has at least four wheels in contact with the ground;
c) Is capable of transporting at least eight passengers, including the driver;
d) Is a commercial motor vehicle as defined in statute;
e) Is a vehicle for hire as defined in statute and operates under a vehicle for hire company permit;
f) Complies with the definition and standards for low-speed vehicles set forth in federal motor vehicle safety standards and the code of federal regulations;
g) Includes a vehicle that meets the aforementioned standards and has been modified after market, not by the manufacturer to transport up to 15 passengers, including the driver. (Sec. 1)
2. Prohibits a neighborhood electric shuttle from being operated at a speed of more than 25 MPH. (Sec. 1)
3. Prohibits a neighborhood electric shuttle from driving on a highway that has a posted speed limit of more than 35 MPH, except for crossing a highway that has a posted speed limit of more than 35 MPH at an intersection. (Sec. 2)
4. Requires that a neighborhood electric shuttle must have a notice of the operational restrictions applying to the vehicle permanently attached to or painted on the vehicle in a location that is in clear view of the driver. (Sec. 2)
5. Requires a person applying for initial registration of a neighborhood electric shuttle to certify in writing that a notice of the operational restrictions applying to the vehicle are contained on a permanent notice attached to or painted on the vehicle in a location that is in clear view of the driver. (Sec. 3)
6. Stipulates that neighborhood electric shuttles are defined as motor vehicles for the purpose of the alternative fuel vehicle license tax. (Sec. 4)
