SB 1138: address confidentiality program; continuation

Sponsor:  Senator Boyer, LD 20

House Engrossed

Overview

Extends the Address Confidentiality Program until July 1, 2031.

History

The Secretary of State (SOS) is charged with establishing the Address Confidentiality Program in order to allow people who have been subjected to sexual offense, domestic violence offenses or stalking to keep their residence address confidential and not accessible to the public.  Participants in this program receive a substitute address that becomes the participant's lawful address of record.

The SOS, under the Address Confidentiality Program, is required to designate a substitute address for a participant that is used by local and state government entities as set forth in statute.  Additionally, the SOS must receive first-class, certified or registered mail sent to a participant at a substitute address and forward the mail to the participant for no charge.  At the program participant's expense, the SOS may receive and forward other classes or kinds of mail, but the SOS is not required to track or otherwise maintain records of any mail received on behalf of the participant unless the mail is certified or registered mail.

Current law terminates the Address Confidentiality Program on July 1, 2021 (A.R.S. § 41-162).
