HB 2791: appropriation; peace officer training equipment

Overview

Establishes requirements for using money in the Peace Officer Training Equipment Fund and appropriates $2,000,000 from the state General Fund (GF) in FY 2022 to the Peace Officer Training Equipment Fund.

History

The Peace Officer Training Equipment Fund (Fund) is established consisting of monies deposited from surcharges on fees charged by court authorized diversion programs and time payment fees. The State Treasurer is directed to invest and divest monies in the Fund and monies earned from investments must be credited to the Fund. Monies in the Fund can only be used for peace officer equipment (A.R.S. § 41-1731).

The Department of Public Safety (DPS) is responsible for creating and coordinating services for use by local law enforcement agencies in protecting the public safety. DPS required to formulate plans with a view to establish modern services for prevention of crime, apprehension of violators, training of law enforcement personnel and the promotion of public safety (A.R.S § 41-1711).

Provisions

2.   Requires all training equipment purchased with monies in the Fund to be purchased under an existing supply schedule contract with DPS. (Sec. 1)

3.   States that an eligible vender must participate in a cooperative purchasing agreement with the Arizona Department of Administration. (Sec. 1)

4.   Requires an applicant for peace officer training equipment funding to:

a)   Contact the sales representative for the training equipment manufacturer (manufacturer) of its choice to establish a needs-based proposal; and

b)   Submit a formal, written request to the Chief Procurement Officer of DPS, including a price quote provided to the applicant by the manufacturer. (Sec. 1)

5.   Mandates DPS to notify the manufacturer that an applicant has requested to purchase a piece of equipment within a reasonable amount of time, and subject to the available monies in the fund. (Sec. 1)

6.   Requires DPS to provide the manufacturer with the name of the applicant and the name and contact information of the applicant’s representative who will coordinate the purchase of the requested equipment. (Sec. 1)

7.   States that virtual training simulators purchased with money in the Fund must:

a)   Include an electronic impulse device to simulate consequences during screen-based simulation training;

b)   Be preloaded with nationally recognized, certified curriculum and interactive visual coursework; and

c)   Seamlessly display real and completely interactive videos across all interconnected screens. (Sec. 1)

8.   Appropriates $2,000,000 from the state GF in FY 2022 to the Fund. (Sec. 2)
