HB 2790: prisoners; escape; classification

Overview
Modifies classification and penalty for escaping from an adult correctional facility.
History
Knowingly escaping or attempting to escape from a juvenile secure care facility, juvenile detention facility or an adult correctional facility as escape in the second degree with a penalty of a class 5 felony. (A.R.S. § 13-2503).
If the escape or attempt to escape involved the use or threat of use of physical force, a deadly weapon or a dangerous instrument against another person, it is classified as escape in the first degree. Escape in the first degree is classified as a class 4 felony. Sentences imposed for a committing escape in the first degree are required to be served consecutively to any sentence of imprisonment or any term of community supervision. (A.R.S. § 13-2504).
Provisions
1. Classifies knowingly escaping from an adult correctional facility as escape in the first degree. (Sec. 2)
2. Changes the penalty for escape in the first degree to a class 2 felony. (Sec. 2)
3. Requires a sentence imposed for committing escape in the first degree to run consecutively to a term of confinement in a secure care facility. (Sec. 2)
