Overview

Outlines requirements for investigations when a law enforcement officer uses deadly force causing another person's death.

History

The use of deadly force by a peace officer against another is justified according to statute only when the peace officer reasonably believes that the following applies:

1)   To defend against the use or imminent use of deadly physical force by another; or

2)   To arrest or prevent the escape of a person from custody and the person is attempting or committing a felony involving a deadly weapon, attempting to escape by use of a deadly weapon or the person is likely to endanger other people (A.R.S. § 13-410). 

Provisions

1.   Mandates when a law enforcement officer uses deadly force and causes another person's death, the investigation into the use of force must be conducted by a law enforcement officer who is not from the same law enforcement agency as the officer, the attorney general or a county attorney from another county. (Sec. 1)
