Overview
Requires the Legislature to approve settlements by consent decree (decree) if the decree requires an appropriation or statutory change.
History
The Governor is currently required to report to the Legislature, each session, any judgments that are rendered against this state and that were not previously reported. Additionally, the Arizona Department of Administration (ADOA) Director is directed to draw a warrant for payment of the judgment on presentation of an authenticated copy of the judgment with the approval of the judgment by the Attorney General. However, the ADOA Director cannot draw the warrant until an appropriation is made by the Legislature for the warrant (A.R.S. § 12-826).
Provisions
1. Requires the Legislature to approve, by joint resolution and signed by the Governor, any settlement by decree if the decree requires an appropriation or statutory change at the time of the proposed decree or at some time in the future. (Sec. 1)
