HB 2588: driver licenses; foster youth

Overview

Allows a child who is at least 16 years of age and either does not have a residence address or is in the Department of Child Safety's (DCS) custody to apply for a nonoperating license or receive a copy of the child's certificate of birth registration without needing the signature a parent or guardian.

History

Pursuant to A.R.S. § 28-3165, a person who does not have valid driver license issued by Arizona or whose driving privilege is suspended, the Arizona Department of Transportation upon receipt of an application shall issue a nonoperating identification license that contains a distinguishing number assigned to the licensee, the full legal name, the date of birth, the residence address and a brief description of the license and either a facsimile of the signature of the licensee or a space on which the licensee is required to write the licensee’s usual signature with pen and ink.

On written request, a local registrar, a deputy local registrar or the state registrar is required to issue a certified copy of a registered certificate except the portion of the certificate that contains medical information to any person determined to be eligible to receive the certified copy pursuant to criteria prescribed by rules (A.R.S. § 36-324). 9 A.A.C. 19, R9-19-210 outlines individuals who are eligible to receive a certified copy of a person's certificate of birth registration. An individual themselves must be of legal age or married to receive a copy the person's certificate of birth registration.

Provisions

1.   Allows a child who is at least 16 years of age and either does not have a residence address or is in DCS's custody to apply for a nonoperating license without needing a signature from a parent, guardian, foster parent or employer. (Sec. 1)

2.   Allows a child who is at least 16 years of age and either does not have a residence address or is in DCS's custody to receive a certified copy of the child's certificate of birth registration without needing the signature of a parent, guardian or foster parent. (Sec. 2)
