HB 2552: criminal damage; monuments; memorials; statues

Overview

Expands aggravated criminal damage to include intentionally or recklessly damaging a public or private monument, memorial or statue. Establishes this offense as either a class 4, 5 or 6 felony, depending on damages.

History

A person commits aggravated criminal damage by intentionally or recklessly, and without the owner's permission, damaging any building or place used as a school, educational facility, place of worship, cemetery, mortuary, utility, agricultural property or construction site.

Penalties for aggravated criminal damage range from a class 3 felony to a class 6 felony.

Class 3 felonies include:

a)   Damages of $10,000 or more for an agricultural property, utility or construction site.

Class 4 felonies include:

a)   Damages of $10,000 or more for a place of worship, school, educational facility, cemetery or mortuary; or

b)   Damages of $1,500 or more but less than $10,000 for an agricultural property, utility or construction site.

Class 5 felonies include:

a)   Damages of $1,500 or more but less than $10,000 for a place of worship, school, educational facility, cemetery or mortuary; or

b)   Damages less than $1,500 for an agricultural property, utility or construction site.

Class 6 felonies include:

a)   Damages less than $1,500 for a place of worship, school,    educational facility, cemetery or mortuary (A.R.S. § 13-1604).

 

Provisions

2.   Establishes the following penalties for aggravated criminal damage of a public or private monument, memorial or statue:

a)   Class 4 felony if the damages are $10,000 or more;

b)   Class 5 felony if the damages are between $1,500 and less than $10,000; or

c)   Class 6 felony if the damages are less than $1,500.  (Sec. 1)
