Overview

Permits a school district governing board (governing board) to provide food and beverages at school district events.

History

The Arizona Department of Education (ADE) is statutorily required to develop minimum nutrition standards that meet federal guidelines and regulations for food and beverages sold or served on elementary school, middle school and junior high school grounds during the normal school day. Statute authorizes ADE to develop minimum nutrition standards that are more stringent than the federal guidelines.

Food and beverages sold or served on elementary school, middle school or junior high school grounds or at school-sponsored events during the normal school day must meet ADE's nutrition standards. Statute does not prohibit or limit the sale or distribution of: 1) any food or beverage item through fundraising activities of students, teachers or educational groups when the items are intended for sale off school grounds; or 2) any food or beverage items limited to teachers, administrators or other adults in a faculty lounge or under other circumstances where the sale or distribution is limited to teachers, administrators or other adults.

All elementary schools, middle schools and junior high schools are required to participate in the National School Lunch Program. A school district with fewer than 100 pupils that is not currently participating in the National School Lunch Program is exempt from this requirement if the governing board opts not to participate (A.R.S. § 15-242).
