HB 2099: missing and murdered indigenous peoples

Overview

Modifies the Study Committee on Missing and Murdered Indigenous Peoples (MMIP) and appropriates an unspecified sum of monies from the Consumer Protection-Consumer Fraud Fund in FY 2022 to the Attorney General (AG) for the Study Committee on MMIP.

History

The Study Committee on Missing and Murdered Indigenous Women and Girls (MMIWG), was established by Laws 2019, Chapter 232 to conduct a comprehensive study to determine how Arizona can reduce and end violence against Arizona indigenous women and girls. The Study Committee on MMIWG was chaired by Representative Jennifer Jermaine and consisted of various members from the House of Representatives, State Senate, Tribal Nations and other members appointed to the Committee. Arizona State University, in partnership with the Study Committee on MMIWG, published a statewide study on Reducing Missing and Murdered Indigenous Women and Girls in November 2020 that contains facts, figures findings of the study.

The Consumer Protection-Consumer Fraud Fund (Fund) consists of any investigative or court costs, attorney fees or civil penalties recovered for the state by the attorney general as a result of enforcement of either state or federal statutes pertaining to consumer protection or consumer fraud, whether by final judgment or settlement. The costs, penalties or fees recovered by a county attorney must be retained in the county and used for investigative operations for consumer protection in the county (A.R.S § 44-1531.01).

Provisions

2.   Makes the following modifications to the members of the Study Committee on MMIP:

a)   Decreases, from four to three, the number of members of the House of Representatives and the number of members of the State Senate who are of indigenous decent or who actively work on issues relating to indigenous peoples;

b)   Strikes the following members from being appointed by the Speaker of the House of Representatives:

  i.   One peace officer who works and resides on a federally recognized American Indian reservation in Arizona; and

ii.   One representative who is from the Southwest Indigenous Women’s Coalition;

c)   Removes the following members from being appointed by the President of the Senate:

  i.   One county attorney and one sheriff from a county with a population of less than 850,000 people;

ii.   One chief of police from a tribal police department; and

  iii.   One representative who works with a tribal, statewide or local organization that provides legal services to indigenous women and girls; and

d)   Adds one attorney general or judge from a tribal jurisdiction to be appointed by the President of the Senate to the Study Committee on MMIP. (Sec. 1)

3.   Modifies the duties and responsibilities of the Study Committee on MMIP. (Sec. 1)
