HB 2083: safety features; autonomous vehicles; prohibitions

Overview

Prohibits a person from overriding the safety features of an autonomous vehicle.

History

A person is prohibited from driving or moving a motor vehicle, tow truck, trailer, semitrailer or pole trailer unless: 1) the equipment on the vehicle is in good working order and adjustment as required by law; and 2) the vehicle is in a safe mechanical condition that does not endanger the driver, passengers or another person on the highway (A.R.S. § 28-981).

Motor vehicle is defined as a self-propelled vehicle or a vehicle that is propelled by the use of motor vehicle fuel (A.R.S. § 28-101).

Vehicle is defined as a device in, on or by which a person or property is or may be transported or drawn on a public highway (A.R.S. § 28-101).

Provisions

1.   ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteProhibits a person from installing or using a defeat device to interfere with or disable a safety feature of a vehicle that:

a)   Is equipped with level two, three, four or five driving automation as defined in the Society of Automotive Engineers Recommended Practice J3016; and

b)   Is designed to ensure that a human driver is alert and attentive while the vehicle's level two, three, four or five driving automation features are engaged. (Sec. 1)

2.   Exempts the following:

a)   An entity that is testing or operating one or more vehicles that are equipped with automated driving systems pursuant to executive orders or other programs authorizing the testing or operation of vehicles equipped with automated driving systems; or

b)   A motor vehicle manufacturer, service center, motor vehicle dealer, motor carrier, component manufacturer or automated vehicle technology developer that is making motor vehicle manufacturer-approved modifications.  (Sec. 1)

1.   Clarifies that a person must knowingly and intentionally use a defeat device.

2.   Narrows the prohibition to vehicles equipped with level two and three driving automation.

3.   Expands the exemption to include:

a)   An entity testing or operating vehicles pursuant to any laws; and

b)   A motor vehicle diagnostic service provider, independent repair facility and auto glass repair, replacement and recalibration provider making manufacturer-approved modifications.

4.   Modifies the definition of Defeat Device to apply to modifications that directly and intentionally affect safety features.

5.   Eliminates the definition of Install or Use a Defeat Device.
