SENATE AMENDMENTS TO H.B. 2830

(Reference to House engrossed bill)

 


Strike everything after the enacting clause and insert:

"Section 1. Title 16, chapter 1, article 3, Arizona Revised Statutes, is amended by adding section 16-132, to read:

START_STATUTE16-132. Voter registration assistance; hunting, fishing, trapping licenses; concealed weapons permits; definitions

A. The Arizona game and fish department and the department of public safety shall provide the opportunity to register to vote for those persons  who will be eighteen years of age or older within the immediately following six months and who apply for a license or permit issued by either department or who contact either department to renew a license or permit.  Each department's application for a license or permit shall serve as an APPLICATION to register to vote unless the person checks the "no" box prescribed by this subsection or does not provide a second signature for purposes of registering to vote.  Each department shall provide to applicants a statement form that includes the statement "If you are not registered to vote where you live now, would you like to apply to register to vote here today?

( ) Yes    ( ) No

If you do not check either box, you will be considered to have decided to register to vote."

B. The statement form shall also include a statement that indicates each eligibility requirement for voting, including:

1. Citizenship.

2. an attestation that the applicant meets each requirement.

3. the applicant's signature under penalty of perjury.

4. In print that is identical to that used in the attestation, the following:

(a) A description of the penalties provided by law for submitting a false voter registration application.

(b) A statement that if an applicant declines to register to vote, the fact that the applicant has declined to register will remain confidential and will be used only for voter registration purposes.

(c) A statement that if an applicant does register to vote, the office at which the applicant submits a voter registration application will remain confidential and will be used only for voter registration purposes.

C. If a person indicates "no" on the form prescribed by subsection A of this section or if the person does not sign the voter REGISTRATION application, the form or application shall be deemed to indicate a declination to register to vote.  The secretary of state and the department shall cooperate in determining how to retain declination forms.  Declination forms are exempt from title 39, chapter 1 and may be disclosed only for voter registration purposes.

D. The secretary of state and the department shall consult and cooperate to create one or more forms and any procedures required to implement this section. The form shall not require the applicant to duplicate any information contained in the application for the license or permit other than a second signature and shall include at least the information prescribed in section 16-121.01.

E. Voter registration information that is generated pursuant to this section and that is public information as otherwise provided by law shall not provide any public indication of the source of these registrations.

F. A person who is a license dealer for the Arizona game and fish department or who RECEIVES an application for a license or permit at the Arizona game and fish department or the department of public safety shall NOT:

1. Seek to influence an applicant's political preference.

2. Display on the person's body any indicator of political preference or political party.

3. Make any statement to an applicant or take any action that has the purpose or effect of discouraging the applicant from applying to register to vote.

4. Make any statement to an applicant or take any action that has the purpose or effect of leading the applicant to believe that a decision to apply to register or not to apply to register to vote has any bearing on the availability of services or benefits from the department.

G. The department shall accept completed registration forms from persons who receive a registration form from that office and shall transmit those completed forms to the secretary of state daily. The secretary of state shall forward the applications to the appropriate county recorder to determine the eligibility of the applicant and, if found eligible, to add the applicant's name to the voter registration rolls.

H. Persons who act pursuant to this section, including license dealers for the Arizona game and fish department, are not considered to be deputy registrars under this title or any rules adopted under its authority.

I. For the purposes of this section:

1. "Department" means the Arizona game and fish department or the department of public safety.

2. "License" means a hunting, fishing or trapping license issued by the Arizona game and fish DEPARTMENT or by an Arizona game and fish department license dealer pursuant to title 17, chapter 3.

3. "Permit" means a concealed weapons PERMIT issued by the department of public safety pursuant to section 13-3112.END_STATUTE"
