FLOOR AMENDMENT EXPLANATION

· Requires the Director of the Department of Environmental Quality to add to the protected surface waters list all waters within the jurisdiction of the state that have cultural or religious importance to the recognized Indian tribes of Arizona.

· Requires the Director, when developing the protected surface waters list, to consider any claim by a federally recognized Indian tribe that the water is of cultural or religious importance to the tribe.

“(h) ALL WATERS WITHIN THE JURISDICTION OF THIS STATE THAT HAVE CULTURAL OR RELIGIOUS IMPORTANCE TO THE RECOGNIZED INDIAN TRIBES IN THIS STATE.”

Page 24, between lines 6 and 7, insert:

“5. THE DIRECTOR SHALL CONSIDER ANY CLAIM BY A FEDERALLY RECOGNIZED INDIAN TRIBE THAT THE WATER IS OF CULTURAL OR RELIGIOUS IMPORTANCE TO THE TRIBE.”
