HOUSE OF REPRESENTATIVES AMENDMENTS TO S.B. 1387

Strike everything after the enacting clause and insert:
"Section 1. Title 32, chapter 11, article 2, Arizona Revised Statutes, is amended by adding sections 32-1242 and 32-1243, to read:
32-1242. Dental responders; definition
A. A dental responder is deemed to be acting within the bounds of the dental responder's license when providing vaccines and dental humanitarian medical care during a declared local, state or national emergency.
B. For the purposes of this section, "dental responder" means a dentist or dental hygienist who is appropriately certified by the board in disaster preparedness and dental humanitarian medical response and to provide vaccines.
32-1243. Dentists and dental hygienists; administration of certain vaccines; certification; reporting requirements; advisory committee; rules
A. Notwithstanding section 32-1242, dentists and dental hygienists may administer vaccines on completion of appropriate training pursuant to rules adopted by the board.
B. dentists and dental hygienists may administer only the influenza and covid-19 vaccines and only to patients who are at least eighteen years of age. Vaccines shall be administered by the dentist or may be delegated to a dental hygienist who is either:
1. acting under the direct supervision of a dentist.
2. acting under general supervision if the supervising dentist who performed an examination of the patient in the preceding twelve months approves the patient for the administration of the vaccine by the dental hygienist under general supervision and documents this approval in the patient's record.
C. A dentist or dental hygienist who wishes to administer vaccines pursuant to this section shall be certified by the board after meeting board requirements for certification as prescribed by rules adopted by the board.
D. A dentist or dental hygienist who administers a vaccine pursuant to this section shall do all of the following:
1. Report to the state immunization information system established by the department of health services.
2. Maintain a record of the immunization pursuant to title 12, chapter 13, article 7.1 and as prescribed by the board in rule.
3. Notify the patient's identified primary care provider or physician, within twenty-four hours after occurrence, of any adverse reaction that is reported to or witnessed by the dentist or dental hygienist and that is listed by the vaccine manufacturer as a contraindication to further doses of the vaccine.
4. Notify the vaccine adverse event reporting system in accordance with the recommendations of the United States centers for disease control and prevention's advisory committee.
E. The board shall adopt rules for dentists and dental hygienists to administer vaccines pursuant to this section that include all of the following:
1. Protocols in accordance with current United States department of health and human services standards for adult immunizing practices.
2. Recordkeeping and reporting requirements.
3. Requirements and qualifications for dentists and dental hygienists to be certified pursuant to this section.
4. Vaccine information and educational materials for those requesting vaccines and immunizations.
5. Emergency management policies and procedures.
F. The board may appoint an advisory committee to assist the board in adopting and amending rules and developing protocols relating to the administration of vaccines and certification requirements pursuant to this section.
G. The board or the advisory committee appointed by the board shall hold one public hearing before adopting the rules and any amendments to the rules pursuant to this section.
Sec. 2. Exemption from rulemaking
Notwithstanding any other law, for the purposes of this act, the state board of dental examiners is exempt from the rulemaking requirements of title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act.
Sec. 3. Emergency
This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law."
