AN ACT

 

amending Title 41, chapter 4, article 7, Arizona Revised Statutes, by adding sections 41-801 and 41-802; appropriating monies; relating to electric vehicles.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 4, article 7, Arizona Revised Statutes, is amended by adding sections 41-801 and 41-802, to read:

START_STATUTE41-801.  Zero emission vehicle plan; definition

A.  IN COORDINATION WITH THE DEPARTMENT OF ENVIRONMENTAL QUALITY and the department of administration, tHE DEPARTMENT OF TRANSPORTATION SHALL DEVELOP A ZERO EMISSION VEHICLE PLAN DESIGNED to:

1.  INCREASE THE NUMBER OF REGISTERED ZERO EMISSION VEHICLES IN THis STATE TO AT LEAST one hundred thousand BY 2027.

2.  HELP ESTABLISH INTERSTATE AND INTRASTATE ZERO EMISSION VEHICLE CORRIDORS.

3.  COORDINATE AND INCREASE THE INSTALLATION OF ZERO EMISSION VEHICLE INFRASTRUCTURE.

4.  WHERE APPROPRIATE, INCORPORATE ADDITIONAL BEST PRACTICES FOR INCREASING ZERO EMISSION VEHICLE ADOPTION.

B.  WITHIN SIX MONTHS AFTER THE EFFECTIVE DATE OF THIS section, THE DEPARTMENT OF TRANSPORTATION SHALL SUBMIT A DRAFT OF THE ZERO EMISSION VEHICLE PLAN TO THE GOVERNOR, THE PRESIDENT OF THE SENATE AND THE SPEAKER OF THE HOUSE OF REPRESENTATIVES.

C.  FOR THE PURPOSES OF THIS SECTION, "ZERO EMISSION VEHICLE" MEANS A PURE BATTERY ELECTRIC VEHICLE OR A PLUG-IN HYBRID ELECTRIC VEHICLE WITH A BATTERY RANGE THAT IS SUFFICIENT TO MEET THE VEHICLE'S REGULAR MILEAGE BETWEEN CHARGES. END_STATUTE

START_STATUTE41-802.  State zero emission motor vehicle fleet; plan; definition

A.  STATE AGENCIES SHALL PRIORITIZE ZERO EMISSION VEHICLES IN purchasing and leasing NEW VEHICLES AND SHALL USE ZERO EMISSION VEHICLES FOR AGENCY BUSINESS TRAVEL WHEN FEASIBLE.  WHEN ZERO EMISSION VEHICLE USE IS NOT FEASIBLE, STATE AGENCIES SHALL PRIORITIZE COST-EFFECTIVE, LOW EMISSION ALTERNATIVES.

B.  TO IMPLEMENT THIS SECTION, THE DEPARTMENT OF transportation SHALL DEVELOP A state zero emission MOTOR vehicle FLEET PLAN THAT:

1.  IDENTIFIES THE TYPES OF TRIPS FOR WHICH A ZERO EMISSION VEHICLE IS FEASIBLE.

2.  RECOMMENDS INFRASTRUCTURE NECESSARY TO SUPPORT ZERO EMISSION VEHICLE USE.

3.  DEVELOPS PROCUREMENT OPTIONS AND STRATEGIES TO INCREASE THE PURCHASE AND Use OF ZERO EMISSION VEHICLES.

C.  WITHIN ONE YEAR AFTER THE EFFECTIVE DATE OF THIS section, THE DEPARTMENT OF transportation SHALL SUBMIT A DRAFT OF THE state zero emission MOTOR vehicle fleet PLAN TO THE GOVERNOR, THE PRESIDENT OF THE SENATE AND THE SPEAKER OF THE HOUSE OF REPRESENTATIVES.

D.  FOR THE PURPOSES OF THIS SECTION, "ZERO EMISSION VEHICLE" MEANS A PURE BATTERY ELECTRIC VEHICLE OR A PLUG-IN HYBRID ELECTRIC VEHICLE WITH A BATTERY RANGE THAT IS SUFFICIENT TO MEET THE VEHICLE'S REGULAR MILEAGE BETWEEN CHARGES. END_STATUTE

Sec. 2.  Appropriation; department of transportation; state zero emission motor vehicle fleet plan; exemption

A.  The sum of $500,000 is appropriated from the state general fund in fiscal year 2021-2022 to the department of transportation to acquire telematics technology to develop the state zero emission motor vehicle fleet plan prescribed by this act.

B.  The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
