A JOINT RESOLUTION

 

Approving the sale of private real property to the United States of America for and on behalf of the United States department of veterans affairs.

Whereas, article I, section 8, clause 17 of the Constitution of the United States and section 37-620.02, Arizona Revised Statutes, provide that this state may consent to the United States acquiring privately owned real property within this state only if the Legislature adopts and the Governor signs a joint resolution to that effect; and

Whereas, section 37-620.01, Arizona Revised Statutes, that requires the joint resolution recite the legal description of the land and the purposes to which this state consents that the property may be used.

Therefore

Be it resolved by the Legislature of the State of Arizona:

1. That the State of Arizona consents to the sale of the land described in paragraph 2 of this section to the United States of America for and on behalf of the United States department of veterans affairs for the purpose of use by the United States department of veterans affairs.

2. That the land referred to in paragraph 1 of this section is described as follows:

Parcel 1: Amended lot 17, in Tucson international gateway center, Pima County, Arizona, according to the map or plat thereof on record in the office of the Pima County Recorder in book 52 of maps and plats at page 56:

That portion of the southwest quarter of the southeast quarter of section 9, township 15 south, range 14 east, of the Gila and Salt River base and meridian, Pima County, Arizona, described as follows:

Commencing at south quarter corner of section 9, township 15 south, range 14 east; thence north 89 degrees 30 minutes 19 seconds east, a distance of 726.35 feet to a point; thence north 00 degrees 29 minutes 41 seconds west, a distance of 75.00 feet to a point on the northerly right-of-way line of Valencia Road; thence north 00 degrees 13 minutes 40 seconds west, a distance of 738.07 feet to a point on the southerly right-of-way line of Britannia Drive; thence north 89 degrees 46 minutes 20 seconds east, a distance of 172.00 feet to a point also being the true point of beginning; thence continue along said bearing of north 89 degrees 46 minutes 20 seconds east, a distance of 129.00 feet to a point; thence south 00 degrees 13 minutes 40 seconds east, a distance of 300.00 feet to a point; thence south 89 degrees 46 minutes 20 seconds west, a distance of 129.00 feet to a point; thence north 00 degrees 13 minutes 40 seconds west, a distance of 300.00 feet to a point back to the true point of beginning.

Parcel 2: Amended lot 18, in Tucson international gateway center, Pima County, Arizona, according to the map or plat thereof on record in the office of the Pima County Recorder in book 52 of maps and plats at page 56:

That portion of the southwest quarter of the southeast quarter of section 9, township 15 south, range 14 east, of the Gila and Salt River base and meridian, Pima County, Arizona, described as follows:

Commencing at south quarter corner of section 9, township 15 south, range 14 east; thence north 89 degrees 30 minutes 19 seconds east, a distance of 726.35 feet to a point; thence north 00 degrees 29 minutes 41 seconds west, a distance of 75.00 feet to a point on the northerly right-of-way line of Valencia Road; thence north 00 degrees 13 minutes 40 seconds west, a distance of 738.07 feet to a point on the southerly right-of-way line of Britannia Drive; thence north 89 degrees 46 minutes 20 seconds east, a distance of 301.00 feet to a point also being the true point of beginning; thence continue along said bearing of north 89 degrees 46 minutes 20 seconds east, a distance of 208.59 feet to a point; thence along a curve to the right with a radius of 40.00 feet, a delta of 90 degrees 00 minutes 00 seconds and an arc length of 62.83 feet to a point; thence south 00 degrees 13 minutes 40 seconds east, a distance of 260.00 feet to a point; thence south 89 degrees 46 minutes 20 seconds west, a distance of 248.59 feet to a point; thence north 00 degrees 13 minutes 40 seconds west, a distance of 300.00 feet to a point back to the true point of beginning.

Parcel 3: Lot 11 and lot 12 except the west 101.58 feet thereof, in Tucson international gateway center, according to the map or plat thereof on record in the office of the Pima County Recorder in book 52 of maps on page 56:

Commencing at the southeast corner of section 9, township 15 south, range 14 east, Gila and Salt River meridian; thence south 89 degrees 30 minutes 19 seconds west along the south line of said section 9, a distance of 1303.58 feet, to the monument line of the hemisphere loop; thence north 00 degrees 13 minutes 40 seconds west along the monument line of said hemisphere loop, a distance of 906.39 feet; thence south 89 degrees 46 minutes 20 seconds west, a distance of 28.00 feet to the west right-of-way line of hemisphere loop, said point being the point of beginning; thence along the arc of a circular curve having a radial bearing of south 89 degrees 46 minutes 20 seconds west concave to the northwest having a radius of 40.00 feet, a central angle of 90 degrees 00 minutes 00 seconds and an arc length of 62.83 feet to a point of tangency; thence south 89 degrees 46 minutes 20 seconds west along the north right-of-way line of Britannia Drive, a distance of 414.00 feet; thence north 00 degrees 13 minutes 40 seconds west, a distance of 437.27 feet; thence north 89 degrees 46 minutes 20 seconds east, a distance of 454.00 feet to the west right-of-way line of hemisphere loop; thence south 00 degrees 13 minutes 40 seconds east along said west right-of-way line, a distance of 397.27 feet to the point of beginning.

Parcel 4: Easements appurtenant created by and described in instrument recorded July 2, 1999, in docket 11081 at page 1027, in the office of the Pima County Recorder.

3. That this act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
