AN ACT

 

amending Title 23, chapter 2, article 1, Arizona Revised Statutes, by adding section 23-206; relating to employment practices.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 23, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 23-206, to read:

START_STATUTE23-206. COVID-19 exposure; notification of employees required

A. If an employer, including a qualified marketplace platform as defined in section 23-1603, in this state becomes aware that a person who has been on the employer's premises has tested positive for COVID-19, the employer shall both:

1. In a timely manner, Notify all employees and contractors, including qualified marketplace contractors as defined in section 23-1603, who may have come into contact with the person who tested positive for COVID-19 that the employee or contractor may have been exposed to someone with COVID-19 while on the employer's premises.

2. Within one week after a potential exposure, Make a reasonable effort to notify all other persons who may have come into contact with the person who tested positive for COVID-19 that the person may have been exposed to someone with COVID-19 while on the employer's premises.

B. When notifying any employee, contractor or other person under subsection A of this section, an employer shall inform the employee, contractor or other person of where the employee, contractor or other person may access a rapid COVID-19 test.  The employer shall again inform the employee, contractor or other person of where the employee, contractor or other person may access a rapid COVID-19 test one week after the initial notification.
