AN ACT
amending sections 28‑414, Arizona Revised Statutes; amending title 41, chapter 1, article 1, Arizona Revised Statutes, by adding section 41-110; appropriating monies; relating to state budget procedures.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 28-414, Arizona Revised Statutes, is amended to read:
28-414. Motor vehicle pool consolidation fund; exemption
Beginning July 1, 2020 2021, the motor vehicle pool consolidation fund is established consisting of monies transferred from the motor vehicle pool revolving fund established by section 41‑804. The department of transportation shall administer the fund. Monies in the fund are subject to legislative appropriation and shall be used to reimburse the department of transportation for costs related to implementing an intergovernmental agreement with the department of administration to operate the state motor vehicle fleet established pursuant to section 41‑803. Monies in the fund are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.
Sec. 2. Title 41, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 41-110, to read:
41‑110. Crisis contingency and safety net fund; exemption; use of monies
A. The crisis contingency and safety net fund is established consisting of monies appropriated to the fund and monies received by the office of the governor from any lawful public or private source. The office of the governor shall administer the fund. Monies in the fund are continuously appropriated. The office of the governor may accept and spend local, state and federal monies and private grants, gifts, contributions and devises to assist in carrying out the purposes of this section. Monies in the fund are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.
B. Monies in the fund may be spent only following a state of emergency declaration by the governor and only for the following forms of economic assistance during the state of emergency:
1. Housing assistance, including payments to prevent eviction or foreclosure.
2. Monies for entities to provide services for homeless persons, including shelter, food, clothing and transportation.
3. Economic assistance to small businesses with fewer than fifty employees, nonprofit organizations and health care providers.
4. Monies for food bank operations.
C. Before spending monies in the fund, the office of the governor shall notify the president of the senate, the speaker of the house of representatives and the joint legislative budget committee on the intended use of the monies.
D. Monies in the fund shall be used to supplement and not supplant any monies allocated by the federal government for economic assistance during a state of emergency.
Sec. 3. Presidential preference election; expenses; reimbursement
Notwithstanding section 16-250, Arizona Revised Statutes, reimbursement of expenses incurred by counties to administer the 2020 presidential preference election shall be made, as determined by the secretary of state, as prescribed by the fiscal year 2020-2021 general appropriations act.
Sec. 4. Unrestricted federal monies; essential government services; retroactivity
A. Any unrestricted federal monies received by this state beginning July 1, 2020 through June 30, 2021 shall be deposited in the state general fund. The monies shall be used to pay essential governmental services.
B. This section applies retroactively to from and after June 30, 2020.
Sec. 5. Rental rates; state-owned buildings; fiscal year 2020‑2021
Notwithstanding section 41‑792.01, subsection D, Arizona Revised Statutes, the capital outlay stabilization fund rental rates for state‑owned buildings in fiscal year 2020‑2021 are $17.87 per square foot for office space and $6.43 per square foot for storage space.
Sec. 6. Budget stabilization fund; exceptions
Notwithstanding section 35‑144, Arizona Revised Statutes, for fiscal years 2020‑2021, 2021‑2022 and 2022-2023 the legislature is not required to appropriate monies to or transfer monies from the budget stabilization fund.
Sec. 7. Eviction policies; intent
The legislature intends for counties, cities and towns to review their eviction policies and procedures during the state of emergency declaration by the governor related to the coronavirus disease 2019 (COVID‑19) to allow individuals and families to remain in their places of residence.
Sec. 8. Supplemental appropriation; crisis contingency and safety net fund; reversion
A. In addition to any other appropriations made in fiscal year 2019‑2020, the sum of $50,000,000 is appropriated from the state general fund in fiscal year 2019-2020 to the crisis contingency and safety net fund established by section 41‑110, Arizona Revised Statutes, as added by this act.
B. Notwithstanding section 35-190, Arizona Revised Statutes, and section 41‑110, Arizona Revised Statutes, as added by this act, the appropriation made in subsection A of this section that is unexpended and unencumbered on June 30, 2021 reverts to the state general fund.
Sec. 9. Retroactivity
Section 28‑414, Arizona Revised Statutes, as amended by this act, applies retroactively to from and after June 30, 2020.
