AN ACT

 

Appropriating monies for child care facilities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Supplemental appropriations; department of economic security; department of health services; child care facilities; reports; rulemaking exemption

A.  In addition to any other appropriations made in fiscal year 2019-2020, the following sums are appropriated from the federal child care development fund block grant in fiscal year 2019‑2020 to the following departments for licensed child care facilities:

1.  $85,005,835 to the department of economic security to provide forgivable loans on a statewide basis to licensed child care facilities that provide child care services for at least six months after receiving a loan and that spend the monies for any of the following purposes:

(a)  Reopening the child care facility and providing child care services.

(b)  Continuing to operate the child care facility and providing child care services.

(c)  Making past and future rental or lease payments for the child care facility.

(d)  Purchasing sanitation supplies and personal protective equipment for the child care facility and the facility's staff.

2.  $3,000,000 to the department of health services to provide a one‑time waiver of the licensure renewal fee for each licensed child care facility.

B.  The department of economic security shall:

1.  Base each loan amount on a per child basis using February 2020 enrollment.

2.  Prorate the loan repayment on a monthly basis for any licensed child care facility that does not remain operational for the time period specified in subsection A, paragraph 1 of this section.

C.  The department of economic security and the department of health services may spend the monies appropriated in subsection A of this section in fiscal years 2019‑2020 and 2020‑2021.

D.  On or before August 1, 2020, February 1, 2021 and August 1, 2021, the department of economic security and the department of health services shall submit a report to the joint legislative budget committee that includes the following information:

1.  Total expenditures by each department.

2.  Expenditures by each department categorized by the type of licensed child care facility, the county of each child care facility and how the monies were spent by each child care facility, if applicable.

3.  From the department of economic security, the amount of the loan that was repaid by each licensed child care facility that received a loan pursuant to this section and that did not remain operational for the time period specified in subsection A, paragraph 1 of this section and the county of each child care facility subject to the loan repayment.

E.  For the purposes of this section, the department of economic security and the department of health services are exempt from the rulemaking requirements of title 41, chapters 6 and 6.1, Arizona Revised Statutes, for one year after the effective date of this act.
