AN ACT

 

amending sections 28‑1521 and 28‑1598, Arizona Revised Statutes; relating to traffic violations.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 28-1521, Arizona Revised Statutes, is amended to read:

START_STATUTE28-1521.  Violation; civil penalty; community restitution

A person who violates a provision of chapter 3 of this title or this chapter:

1.  Except as provided in paragraph 2 of this section, is subject to a civil penalty unless the statute defining the offense provides for a criminal classification.

2.  May perform court‑approved community restitution in lieu of paying a civil penalty, surcharge, assessment or fee. END_STATUTE

Sec. 2.  Section 28-1598, Arizona Revised Statutes, is amended to read:

START_STATUTE28-1598.  Maximum civil penalty; applicability of surcharges and time payment fee

Except as otherwise provided, a civil penalty imposed pursuant to this article shall not exceed two hundred fifty dollars $250.  In addition, the court shall levy surcharges pursuant to sections 12‑116.01 and 12‑116.02 but may not assess the time payment fee prescribed by section 12‑116. END_STATUTE
