FACT SHEET FOR H.B. 2844

 

G&F; transfers; gold star children

Purpose

            Allows the Arizona Game and Fish Commission (Commission) to prescribe procedures and conditions for the transfer of big game permits and tags for use by the child of a U.S. military member who was killed in action.

Background

A person must obtain a license to take, handle or possess wildlife (A.R.S §17-101). A license or permit is not transferable and cannot be used by anyone except the licensee. Statute prescribes exceptions to allow the big game permit and tags to be transferred, in a manner authorized by the Game and Fish Commission, to a qualified organization for use by a minor child with a life-threatening medical condition or permanent physical disability or a veteran of the U.S. armed forces who has a service-connected disability.

A qualified organization is a nonprofit organization that is qualified under section 501(c)(3) of the United States Internal Revenue Code (U.S. IRC) that affords opportunities and experiences to children with life-threatening medical conditions, physical disabilities, or veterans with service-connected disabilities (A.R.S. § 17-332).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Allows the Commission to prescribe procedures and conditions for the transfer and use of big game permits and tags to a qualified organization for use by a Gold Star child.

2.       Requires a Gold Star child who is under 14 years old to satisfactorily complete the Arizona Hunter Education Course or a comparable course approved by the Director of the Arizona Game and Fish Department prior to the beginning of the hunt for which the permit or tag is transferred.

3.      Defines Gold Star child as a minor child whose parent was killed in action while serving in the U.S. military.

4.      Adds, to the definition of qualified organization, a nonprofit organization that is qualified under section 501(c)(3) of the U.S. IRC and that affords opportunities and experiences to Gold Star children.

5.      Makes technical and conforming changes.

6.      Becomes effective on the general effective date.
