SB 1669: vehicle speed limits

Overview
Modifies the classification for excessive speed and adds speeding offenses on public highways that are designated as a waste of finite resources.
History
Pursuant to A.R.S. § 28-701.02, a person is prohibited from exceeding:
1) 35 miles per hour (MPH) approaching a school crossing;
2) The posted speed limit in a business or residential district by more than 20 MPH, or if no speed limit is posted, by more than 45 MPH; or
3) 85 MPH in other locations.
A person who commits an excessive speed violation is guilty of a class 3 misdemeanor (30 days/up to $500 plus surcharges).
Pursuant to A.R.S. § 28-702.01, a person is prohibited from driving a motor vehicle at a speed in excess of 55 MPH on a public highway with a maximum speed limit 55MPH. If the speed at which the person drove is 65MPH or less, the offense is designated as a waste of finite resources and is a civil traffic violation subject to a civil penalty of no more than $15 plus outlined surcharges. This offense does not apply to an interstate system highway located outside an urbanized area.
Provisions
1. Prohibits a person from exceeding the posted speed limit by more than 20 MPH in locations other than a business or residential district or school zone, rather than exceeding an 85 MPH cap.(Sec. 1)
2. Prohibits a person from driving a motor vehicle at a speed in excess of 65 MPH on a public highway with a maximum speed limit of 65MPH.
a) States that an offense is designated as a waste of finite resources, if the speed a person drove is 75MPH or less. (Sec. 2)
3. Prohibits a person from driving a motor vehicle at a speed in excess of 75 MPH on a public highway with a maximum speed limit of 75MPH.

4. Provides that a speeding offense designated as a waste of finite resources on a public highway with a maximum speed of 65MPH or 75MPH is a civil traffic violation and subject to a civil penalty of no more than $15 plus outlined surcharges. (Sec. 2)
5. Provides that a speeding offense that is over 10MPH on a public highway with a maximum speed of 65MPH or 75MPH is subject to a civil penalty of no more that $250. (Sec. 2)
