SB 1352: Fred Korematsu day; observed

Sponsor:  Senator Bradley, LD 10

Caucus & COW

Overview

Establishes January 30th of every year as Fred Korematsu Day of Civil Liberties and the Constitution.

History

The enumerated list of holidays Arizona observes that are not legal holidays are outlined in current statute, with examples being Navajo Code Talker's Day, Purple Heart Day and Public Lands Day (A.R.S. §§ 1-313, 1-316, 1-318).

During World War II, Fred T. Korematsu was an American citizen who was subject to Executive Order 9066 and placed in an internment camp. Mr. Korematsu refused to comply with the order and was subsequently convicted in federal court. Mr. Korematsu appealed his conviction to the United States Supreme Court in the landmark case Korematsu v. United States. The court ruled that the enforced internment was a military necessity. Mr. Korematsu's conviction was later overturned in 1983.
