SB 1020: ballot measures; proposition 105; disclosure

Overview

Requires a Proposition 105 notice be included on certain ballots and publicity pamphlets.

History

Current statute requires the Secretary of State to print a publicity pamphlet when ordered by the Legislature or by petition under the provisions of the State Constitution related to initiative and referendum to submit to the people a measure or proposed amendment to the Constitution.  The publicity pamphlet must include the following information:

1)    The title and text of the measure or proposed amendment;

2)    The form that the measure or proposed amendment will appear on the ballot;

3)    Arguments for and against the measure or amendment;

4)    A Legislative Council analysis of the ballot proposal; and

5)    The summary of a fiscal impact statement (A.R.S. § 19-123).

Provisions

1.    Stipulates that a Proposition 105 notice must be included:

a)    Immediately below the Legislative Council analysis for any statutory measure in a publicity pamphlet; and

b)    On the official ballot immediately before the first proposed state initiative measure and immediately before the proposed state referendum measure. (Sec. 1, 2)

a)    "Notice:  Pursuant to Proposition 105 (1998), these measures cannot be changed in the future if approved on the ballot except by a three-fourths vote of the members of each house of the Legislature and if the change furthers the purpose of the original ballot measure, or by referring the change to the ballot." (Sec. 1)

3.    Requires a descriptive title to be printed on the official ballot below the number of the measure. (Sec. 2)

4.    Contains a severability clause. (Sec. 3)

5.    Makes technical and conforming changes. (Sec. 1, 2)
