"C.  A person who holds a certificate of necessity pursuant to section 36‑2233 does not qualify for the interfacility ambulance service demonstration project.

D.  The service area in which an interfacility transport demonstration permit holder may operate is limited to a county with a population of more than three million persons.

E.  The term of an interfacility transport demonstration permit issued pursuant to this section is five years.

F.  The director shall establish response times for an interfacility transport demonstration permit holder that are consistent with certificate of necessity holders that perform interfacility transports in the same service area. The data shall be collected from a third-party vendor and used to validate response times of the interfacility transport demonstration permit holder. 

G.  At any time, the director may evaluate the performance of the permit holder. If the performance is determined to be substandard, the permit holder shall implement an improvement plan that complies with the requirements of the director.

H.  If an interfacility transport demonstration permit holder achieves both of the following at the end of the five‑year demonstration project, notwithstanding any other law, the director shall issue the permit holder a certificate of necessity:

1.  Response times have been met at least ninety-two percent of the time as determined by the third-party vendor.

2.  The permit holder has achieved or is seeking accreditation by the commission on accreditation of ambulance services."
