AN ACT

 

amending title 9, chapter 4, article 6, arizona revised statutes, by adding section 9-461.18; amending title 11, chapter 6, article 2, arizona revised statutes, by adding section 11-814.01; relating to local planning.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 6, Arizona Revised Statutes, is amended by adding section 9-461.18, to read:

START_STATUTE9-461.18.  Neighborhood variance index; hearing; definitions

A.  If twenty percent of the qualified electors residing in a community petition a planning agency, setting forth the perimeters of the community, to evaluate the neighborhood variance index for the community, the planning agency shall hold a hearing pursuant to section 9-461.09.

b.  the planning agency may prepare specific plans and measures that, in the judgment of the planning agency, may be required to improve the neighborhood variance index in the petitioning community.  the planning agency may recommend such plans and measures to the legislative body for adoption.

c.  For the purposes of this section:

1.  "community" means a locality in which a group of individuals resides in more or less proximity having common interests in services such as public health, police and fire protection and water services and where residents mingle in business, social, educational and recreational activities. 

2.  "neighborhood variance index" means the percentage of residential structures that are being used for purposes other than permanent residential occupancy for a period of at least six months. END_STATUTE

Sec. 2.  Title 11, chapter 6, article 2, Arizona Revised Statutes, is amended by adding section 11-814.01, to read:

START_STATUTE11-814.01.  Neighborhood variance index; hearing; definitions

A.  If twenty percent of the qualified electors residing in a community petition the commission, setting forth the perimeters of the community, to evaluate the neighborhood variance index for the community, the commission shall hold a hearing pursuant to section 11-813.

b.  the commission may prepare specific plans and measures that, in the judgment of the commission, may be required to improve the neighborhood variance index in the petitioning community.  the commission may recommend such plans and measures to the board for adoption. END_STATUTE

c.  For the purposes of this section:
