AN ACT

 

amending Title 33, chapter 7, article 3, Arizona Revised Statutes, by adding section 33-937; relating to health care provider liens.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 33, chapter 7, article 3, Arizona Revised Statutes, is amended by adding section 33-937, to read:

START_STATUTE33-937.  Physical therapists; lien rights; election of remedies; discharge; definition

A.  For a physical therapist who is licensed pursuant to title 32, chapter 19 and who provides treatment to an injured person, both of the following apply:

1.  The physical therapist shall elect to claim either payment under insurance that provides coverage for the injured person's treatment or payment under a lien.  The physical therapist shall make this election before the physical therapist first begins the injured person's treatment.

2.  After making the election prescribed by paragraph 1 of this subsection, any payments received by the physical therapist pursuant to that election constitute a full discharge of the injured person's obligation to the physical therapist and no other claim may be made by the physical therapist, except that If the physical therapist elects payment under the injured person's insurance, the injured person is responsible for any applicable cost sharing requirement.

B.  For the purposes of this section, "cost sharing requirement" means the injured person's applicable coinsurance, copayment and deductible requirements under the injured person's health insurance plan. END_STATUTE
