SENATE BILL 1019

 

 

 

AN ACT

 

appropriating monies to the department of education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Appropriation; department of education; school districts; reimbursement; reversion

A.  The sum of $3,000,000 is appropriated from the state general fund in fiscal year 2019-2020 to the department of education to reimburse affected school districts for property tax refunds that the affected school districts were required to make pursuant to the final order in Transwestern Pipeline Company v. Arizona Department of Revenue, et al., (TX2016‑000931).

B.  The reimbursement prescribed by subsection A of this section is in addition to any adjustment in state aid received pursuant to section 15‑915, subsection B, Arizona Revised Statutes.

C.  If the amount appropriated in subsection A of this section is less than the aggregate amount of the affected school districts' property tax refunds, the department of education shall distribute the monies proportionally among the affected school districts based on the amount each affected school district was required to refund.

D.  If the amount appropriated in subsection A of this section is more than the aggregate amount of the affected school districts' property tax refunds, the excess amount reverts to the state general fund.
