AN ACT
amending title 44, chapter 9, Arizona Revised Statutes, by adding article 27; relating to trade practices.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 44, chapter 9, Arizona Revised Statutes, is amended by adding article 27, to read:
ARTICLE 27. TRANSFER OF BINARY EXPLOSIVES
44-1383. Furnishing of prepackaged binary explosives to minors; minor accepting or receiving prepackaged binary explosives; civil penalties; definition
A. A person may not sell, furnish, dispose of or give to a minor a prepackaged binary explosive. A minor may not buy, receive or have in the minor's possession a prepackaged binary explosive. A person must request identification that contains a purchaser's or recipient's proof of age before conducting a transaction involving a prepackaged binary explosive.
B. A person who sells, furnishes, disposes of or gives to a minor a prepackaged binary explosive in violation of this section is subject to a civil penalty of $500.
C. A minor who buys, receives or has in the minor's possession a prepackaged binary explosive in violation of this section is subject to a civil penalty of $250.
D. For the purposes of this section, "prepackaged binary explosive" means a retail package consisting of binary explosives that when combined result in a mixture that is an EXPLOSIVE material subject to 27 code of FEDERAL regulations part 555.
