AN ACT

 

amending sections 28‑2402, 28‑2473, 28‑2474 and 28‑2475, Arizona Revised Statutes; relating to special plates.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 28-2402, Arizona Revised Statutes, is amended to read:

START_STATUTE28-2402.  Special plate fees; exceptions

The following fees are required:

1.  Twenty‑five dollars $25 for each original and for each annual renewal of special plates issued under this article, except for the following:

(a)  Special plates for hearing impaired persons issued under section 28‑2408. And

(b)  International symbol of access special plates issued under section 28‑2409.

(c)  Veteran special plates issued under section 28‑2414 if both of the following apply:

(i)  The veteran special plates are combined with international symbol of access special plates issued under section 28‑2409.

(ii)  The veteran's disability is a result of the veteran's military service in a combat or noncombat area.

2.  Twelve dollars $12 for a transfer of special plates, unless exempt pursuant to section 28‑2403. END_STATUTE

Sec. 2.  Section 28-2473, Arizona Revised Statutes, is amended to read:

START_STATUTE28-2473.  Former prisoner of war license plates; fees

A.  The department shall issue distinctive license plates to:

1.  A person, other than a person who was discharged from the armed forces under conditions less than honorable, who submits satisfactory proof to the department that the person was captured and incarcerated by an enemy of the United States during a period of conflict with the United States.

2.  The immediate family member of a person who has been issued a license plate pursuant to this section.

B.  Except as provided in subsection C of this section, for each original license plate issued pursuant to this section, the department shall collect a fee of fifteen dollars $15 in addition to the registration fee required by section 28‑2003.  For each annual renewal of license plates issued pursuant to this section, the department shall charge a fee of five dollars $5 in addition to the registration fee required by section 28‑2003.  The department shall deposit, pursuant to sections 35‑146 and 35‑147, the fifteen dollar $15 fee as a donation in the veterans' donations fund established by section 41‑608.

C.  The fees prescribed by subsection B of this section do not apply if both:

1.  The former prisoner of war LICENSE plate is combined with an international symbol of access special plate issued under section 28‑2409.

2.  The person who applies for the plate pursuant to subsection A, paragraph 1 of this section has a disability that is the result of the veteran's military service in a combat or noncombat area. END_STATUTE

Sec. 3.  Section 28-2474, Arizona Revised Statutes, is amended to read:

START_STATUTE28-2474.  Purple heart medal recipient license plates; fees

A.  The department shall issue distinctive license plates to:

1.  A person who submits satisfactory proof to the department that the person is a veteran and a bona fide purple heart medal recipient.

2.  The immediate family member of a person who has been issued a license plate pursuant to this section.

B.  Except as provided in subsection C of this SECTION, for each original license plate issued pursuant to this section, the department shall collect a fee of twenty‑five dollars $25 in addition to the registration fee required by section 28‑2003.  For each annual renewal of license plates issued pursuant to this section, the department shall charge a fee of five dollars $5 in addition to the registration fee required by section 28‑2003. The department shall deposit, pursuant to sections 35‑146 and 35‑147, the twenty‑five dollar $25 fee as a donation in the veterans' donations fund established by section 41‑608.

C.  The fees prescribed by subsection B of this section do not apply if both:

1.  The purple heart medal recipient license plate is combined with an international symbol of access special plate issued under section 28‑2409.

2.  The person applying for the plate pursuant to subsection A, paragraph 1 of this section has a disability that is the result of the veteran's military service in a combat or noncombat area. END_STATUTE

Sec. 4.  Section 28-2475, Arizona Revised Statutes, is amended to read:

START_STATUTE28-2475.  Pearl Harbor survivor license plates; fees

A.  The department shall issue distinctive license plates to:

1.  A person who submits satisfactory proof from the department of veterans' services to the department of transportation that all of the following are true:

(a)  The person was a member of the United States armed forces on December 7, 1941.

(b)  The person received an honorable discharge from the United States armed forces.

(c)  The person was on station on December 7, 1941 during the hours of 7:55 a.m. to 9:45 a.m. Hawaii time at Pearl Harbor, the island of Oahu or offshore at a distance not exceeding three miles.

2.  The immediate family member of a person who has been issued a license plate pursuant to this section.

B.  Except as provided in subsection C of this section, for each original license plate issued pursuant to this section, the department shall collect a fee of twenty‑five dollars $25 in addition to the registration fee required by section 28‑2003.  For each annual renewal of license plates issued pursuant to this section, the department shall charge a fee of five dollars $5 in addition to the registration fee required by section 28‑2003.  The department shall deposit, pursuant to sections 35‑146 and 35‑147, the twenty‑five dollar $25 fee as a donation in the veterans' donations fund established by section 41‑608.

C.  The fees prescribed by subsection B of this section do not apply if both:

1.  The pearl harbor survivor license plate is combined with an international symbol of access special plate issued under section 28‑2409.

2.  The person who applies for the plate pursuant to subsection A, paragraph 1 of this section has a disability that is the result of the veteran's military service in a combat or noncombat area. END_STATUTE
