landlord tenant; state preemption
Purpose
Establishes a state preemption on the regulation of the rights, obligations and remedies of landlords and tenants. Exempts any ordinance or code adopted by a political subdivision before December 31, 2018.
Background
The Legislature enacted the Arizona Residential Landlord and Tenant Act (Act) in 1973 to simplify, clarify, modernize and revise the law governing the rental of dwelling units and the rights and obligations of landlords and tenants (A.R.S. § 33-1302). The Act regulates and determines rights, obligations and remedies under a rental agreement for any dwelling unit located within Arizona, with certain exemptions (A.R.S. §§ 33-1307 and 33-1308). The Act outlines requirements for landlord obligations, tenant obligations and remedies for dispute.
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Asserts that the regulation of rights, obligations and remedies of landlords and tenants pursuant to the Act is a matter of statewide concern and not subject to further regulation by a county, city, town or other political subdivision of the state.
2. Exempts any ordinance or code adopted by a county, city, town or other political subdivision of the state before December 31, 2018.
3. Makes technical and conforming changes.
4. Becomes effective on the general effective date.
