weights and measures; licensing periods

Purpose

            Allows the Arizona Department of Agriculture Weights and Measures Services Division (Division) to issue or renew a commercial device license for two or three years if the applicant or licensee has paid all applicable fees at the time of issuance or renewal.

Background

            The Division is charged with licensing and testing commercial devices to determine the direct cost of goods in the marketplace (A.R.S.  3-3414).

            A commercial device is any weighing, measuring, metering or counting device that is used to determine the direct cost of things sold or offered or exposed for sale, or used to establish a fee for service if the cost is based on weight, measure or count. A commercial device does not include devices used for in-house packaging, inventory control, or law enforcement purposes (A.R.S. § 3‑3401).

Current statute requires commercial devices installed and used in Arizona to be licensed by the Division. A license must be obtained no later than 30 days following the first day of commercial use for original installations and renewed annually (A.R.S.  3-3451). The fees for issuance or renewal license are as follows: $48.00 for a public weighmaster, $24.00 for a registered service agency and $4.80 for a registered service representative (A.R.S.  3-3452).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Allows the Division to issue or renew a commercial device license for two or three years at the option of the applicant or licensee if the applicant or licensee pays the total amount of applicable annual fees in full at the time of issuance or renewal.

2.      Makes technical changes.

3.      Becomes effective on the general effective date.
