History

An alarm or alarm system is defined as any mechanical or electrical device designed to emit an audible alarm or transmit an activated signal used to detect an unauthorized entry into a building or facility or alert a person of a medical emergency or unlawful act against a person in a building or facility. This includes a silent, panic, holdup, robbery, duress, burglary or medical alarm that requires emergency personnel to respond. The definition excludes a telephone call diverter or a system designed to report environmental and other occurrences that is not designed to alert public safety personnel (A.R.S. § 32-101).

An alarm business may not operate an alarm system until certification is received from the Board of Technical Registration (BTR). Each controlling person of an alarm business must provide a valid fingerprint clearance card to the BTR in order to obtain an alarm business certificate. All alarm business and controlling person certificates are valid for three years. An application for a certificate must include all statutorily required information (A.R.S § 32-122.05).

Provisions

1.       Includes low-voltage electric fence in the definition of alarm or alarm system. (Sec. 1)

2.       Defines low-voltage electric fence as a fence that meets the following requirements:

a.       Has an electric fence energizer powered by a commercial storage battery with a rated voltage of 12 volts or less that produces an electric charge on contact;

b.       Is completely enclosed by a nonelectric fence or wall;

c.        Is continuously monitored;

d.       Is attached to ancillary components or equipment;

e.       Does not exceed 10 feet in height or 2 feet higher than the nonelectric fence or wall;

f.         Has identification warning signs attached at intervals of 60 feet or less;

g.       Is not installed in an area zoned exclusively for single or multifamily residential use; and

h.       Does not enclose property that is used for residential purposes. (Sec. 1)                        

3.       Specifies that the regulation of low-voltage electric fence alarm systems is of statewide concern and their use is not subject to further regulations by a county, city, town or other political subdivision. (Sec. 2)
