History

The Federal Motor Carrier Safety Administration (FMCSA) was established on January 1, 2000 within the U.S. Department of Transportation to improve motor carrier safety (49 U.S.C. § 113). Through the Motor Carrier Safety Grant Program, FMCSA provides grants to states for programs to improve motor carrier safety and the enforcement of regulations on commercial vehicles. States must be in compliance with the Performance and Registration Information System Management (PRISM) program by October 1, 2020 to continue to qualify for grant monies (49 U.S.C. § 31102).

The PRISM program is a key component in FMCSA's effort to reduce commercial vehicle accidents. The program links federal motor carrier safety information systems with state commercial vehicle registration and licensing systems to enable a state to: 1) determine the safety fitness of a motor carrier or registrant when licensing or registering the registrant or motor carrier or while the license or registration is in effect; and 2) deny, suspend, or revoke the commercial vehicle registrations of a motor carrier or registrant that has been issued an operations out-of-service order (49 U.S.C. § 31106).

Under the International Registration Plan,  member jurisdictions provide reciprocity in registering commercial vehicles that travel between two or more jurisdictions. The member jurisdictions include all contiguous U.S. states, the District of Columbia and ten Canadian provinces. A.R.S. § 28-2232 authorizes the international proportional registration of commercial vehicles in Arizona. 

Provisions

1.       Allows ADOT to refuse to issue a registration, license plate or permit for a commercial vehicle assigned to a carrier, if the FMCSA prohibits the carrier from operating. (Sec. 1)

2.       Allows ADOT to suspend or revoke a registration, license plate or permit issued for a commercial vehicle assigned to a carrier if either:

a.       The FMCSA prohibits the carrier from operating; or

b.       The carrier knowingly allowed or required an employee to operate a commercial vehicle in violation of a federal out-of-service order. (Sec. 1)

3.       Allows ADOT to reissue a registration, license plate or permit for a commercial vehicle that is assigned to a carrier, if the FMCSA allows the carrier to resume operating. (Sec. 1)

4.       Allows ADOT to issue temporary proportional registrations or temporary registrations for commercial vehicles that have a federal out-of-service order from a previous owner on ADOT's records. (Sec. 2-3)

5.       Defines Out-of-Service Order. (Sec. 1)

6.       Contains a delayed effective date of September 1, 2020. (Sec. 4)

7.       Makes technical and conforming changes. (Sec. 1-3)
