Overview

History

In 1990, Proposition 200 was enacted by the voters, creating the Heritage Fund for the purposes of funding local, regional and state parks, trails, natural areas, historic preservation projects and environmental education.

Laws 2010, 7th Special Session, Chapter 12 redirected lottery distributions for the Heritage Fund to the state General Fund. Before the Heritage Fund was repealed, statute allowed for an annual transfer of up to $10 million from the State Lottery Fund.

Provisions

1.       Re-establishes the Heritage Fund consisting of legislative appropriations, grants and donations. (Sec. 1)

2.       Requires the State Parks Board, in consultation with the Historical Advisory Commission, to:

a.       Establish criteria for the use of monies in the Heritage Fund;

b.       Establish and revise the grant application process; and

c.        Review and evaluate grant applications. (Sec. 1)

3.       Requires monies in the Heritage Fund to be used as follows:

a.       50% on parks for outdoor recreation and open space development, restoration or renovation;

b.       30% on historic preservation, administered through the State Historic Preservation Officer;

c.        10% on nonmotorized trails; and

d.       10% on outdoor and environmental education. (Sec. 1)

4.       Prohibits Heritage Fund monies from being used to acquire property. (Sec. 1)

5.       Prohibits an entity receiving Heritage Fund monies from receiving more than 20% of the monies available in each category in any FY. (Sec. 1)

6.       Requires the State Parks Board to submit an annual report including information on the amount of monies spent and a summary of completed projects to the President of the Senate, Speaker of the House of Representatives and the appropriate legislative committees. (Sec. 1)

7.       Requires the State Treasurer to invest and divest any monies deposited in the Heritage Fund and to credit monies earned from investment to the Heritage Fund. (Sec. 1)

8.       Requires the Auditor General to:

a.       Conduct a performance audit of Heritage Fund programs and expenditures when the performance audit of the State Parks Board is conducted; and

b.       Submit the performance audit to the President of the Senate, Speaker of the House of Representatives and the appropriate legislative committees. (Sec. 1)

9.       Exempts Heritage Fund monies from lapsing. (Sec. 1)
