SB 1185: weights and measures; licensing periods

Overview

Allows the Weights and Measures Services Division of the Department of Agriculture (Division) to issue or renew a commercial device license for longer periods of time if all applicable fees are paid.

A commercial device is any weighing, measuring, metering or counting device used to either: 1) determine the direct cost of items for sale; or 2) establish a fee for service if the cost is based on weight, measure or count. Devices used for in-house packaging, inventory control or law enforcement purposes are not considered commercial devices (A.R.S. § 3-3401).

Commercial devices installed and used in Arizona are required to be licensed by the Division within 30 days of the first commercial use and licenses must be renewed annually (A.R.S. § 3-3451).

A.R.S. § 3-3452 outlines the fees for licensure of devices used for commercial purposes and a list of the fees can be found on the Arizona Department of Agriculture's website.

Provisions

1.       Allows the Division to issue or renew a device license for two or three years if the applicant or licensee pays the total amount of applicable annual fees in full at the time of issuance or renewal. (Sec. 1)
