Overview

History

A youth group is intended to serve young people under the age of 21 (20 U.S.C. § 7905). Specifically, a youth group listed as a patriotic society (youth group) include organizations like Girl Scouts of America, Boy Scouts of America, Boys and Girls Club of America, and Big Brothers-Big Sisters of America (36 U.S.C. Subtitle II, Part B).

A public elementary or secondary school, local educational agency, or state educational agency that receives funds though U.S. Department of Education and has a designated open forum or a limited public forum cannot deny equal access to, deny a fair opportunity to meet to, or discriminate against any group officially affiliated with any youth group that wishes to hold a meeting in an open forum or a limited public forum (20 U.S.C. § 7905).

Provisions

1.       Allows a public school principal to let representatives from any youth group address students about how youth groups support educational interests and civic involvement for up to 10 minutes during regular school hours during the first quarter of each academic school year.

2.       Requires a representative from a youth group to submit a verbal or written request to the school principal during the first two weeks of the academic school year if the youth group intends to address students.

3.       Permits the principal to notify the youth group of the date and time in which the youth group representative can address the students.

4.       Mandates the principal ensure that materials provided by a youth group are distributed directly to students on school grounds throughout the academic school year to encourage student participation in the youth group.

5.       Allows the principal to request the materials to be approved before distribution and to determine the method of distributing these materials.

6.       Prohibits a public school from denying equal access to, or a fair opportunity to meet to, or discriminating against a youth group that wishes to hold a meeting in an open forum or a limited public forum.

7.       Defines youth group listed in 36 United States Code, Subtitle II, Part B as a patriotic society as any group or organization that intends to serve youth and is listed in 36 U.S.C. Subtitle II, Part B, or any of the group's or organization's affiliates.
