Establishes the Health Care Professional
Workforce Data Repository (Repository), the Workforce Data Repository Fund
(Fund) and the Health Care Professional Workforce Data Repository Advisory
Committee (Committee) to collect and maintain information from health
professionals.
History
Laws 2018, Chapter 293 (HB2197) created the Health Professionals Workforce Database and requires the Health Professional Regulatory Boards (Boards), starting January 2, 2020, to collect information from the individuals seeking an initial or renewal license, certification or registration.
The Ad Hoc Committee on Health Care Workforce was established to research and make recommendations for the collection and publication of relevant data concerning the health care professions workforce. The Ad Hoc Committee met on October 2, 2017 and December 18, 2018 and recommended: 1) to adopt legislation that directs licensing boards to collect workforce data as part of the licensing and renewal process; and 2) that stakeholders, licensing boards and interested parties work with the Arizona Area Health Education Center to assist in preparing future legislation.
Provisions
The Repository
1. Requires Department of Health Services (DHS) to establish and maintain the Repository containing the data collected and transferred to DHS regarding health professionals. (Sec. 3)
2. Allows DHS to assist the Boards in complying with a standardized format and securely transferring the collected data. (Sec. 3)
3. Requires DHS to adopt rules to do the following:
a. Provide procedures for the transfer of data from the Boards;
b. Maintain privacy and security of the data;
c. Specify the conditions and agreements to release data; and
d. Establish a fee to provide the data in the Repository to a person requesting information. (Sec. 3)
4. Stipulates that the information in the Repository is not a public record, and allows DHS to provide the data only:
a. Subject to the conditions and agreements required by the rules;
b. Without any personally identifiable information; and
c. For a fee that is not based on the intended use of the data. (Sec. 3)
The Fund
5. Establishes the Fund consisting of legislative appropriations, fees, private gifts, grants, donations and contributions. (Sec. 3)
6. Requires DHS administer the Fund, which is continuously appropriated. (Sec. 3)
7. Allows the Director of DHS (Director) to accept and spend private gifts, grants, donations and contributions to assist in carrying out the purposes of the Repository. (Sec. 3)
8. Specifies monies remaining in the Fund at the end of each FY do not revert to the state General Fund (GF) and are exempt from lapsing. (Sec.3)
The Committee
9. Establishes the Committee to advise the Director regarding rules and policies relating to the operation of the Repository. (Sec. 3)
10. Requires the Committee to consist of at least 14 but not more than 15 members who are appointed by the Director. Committee membership includes:
a. The Director or the Director's designee, who serves as the chairperson;
b. One person who represents each health profession regulatory board that collects and transfers data to the Repository;
c. At least two persons who represents state universities;
d. At least one person who represents a state community college;
e. Two members who represent hospitals in a county within the state:
i. One from a population of 500,000 or more; and
ii. One from a population of 500,000 or less;
f. One Behavioral Health Provider;
g. One Outpatient Services Provider; and
h. At least one person who represents a non-profit organization that conducts research and education related to health care. (Sec. 3)
11. Requires the Committee members to serve three-year terms in a voluntary capacity. Members are eligible to receive expense reimbursement. (Sec. 3)
12. Terminates the Committee on July 1, 2027. (Sec. 3)
Miscellaneous
13. Appropriates $50,000 and .5 FTE positions from the state GF in FY 2020 to DHS to establish and maintain the Repository and assist the boards in collecting and transferring data. (Sec. 4)
14. Extends the date from January 2, 2020 to January 2, 2021 for each board to request, annually, information for the Database from individuals seeking initial or renewal licenses, certification or registration. (Sec. 2)
15. Requires the boards to transfer designated database information to DHS annually. (Sec. 2)
16. Allows each board to maintain and use the data collected from the Database. (Sec. 2)
17. Specifies that all information transferred from each board to the Database is confidential and not a public record. (Sec. 2)
18. Defines terms. (Sec. 1)
19. Makes technical and conforming changes. (Sec. 1,2)
Amendments
Committee on Health and Human Services
1. Includes the Board of Physical Therapy as a regulatory board that can provide information regarding health professionals. (Sec. 1)
