History

Emergency is defined as any unforeseen circumstances that would prevent the elector from voting at the polls.

In current statute, as a result of an emergency occurring between 5:00 p.m. on the second Friday preceding an election and 5:00 p.m. the Monday preceding an election, a qualified voter may request to vote early in the manner prescribed by the county recorder (A.R.S. § 16-542). Additionally, county recorders are authorized to provide emergency balloting for people who experience an emergency between 5:00 p.m. Friday and 5:00 p.m. the Monday preceding a presidential preference election (A.R.S. § 16-246). 

Provisions

1.       Requires a person who receives an emergency ballot to provide valid identification and sign a statement under the penalty of perjury that states that the person is experiencing or experienced an emergency after 5:00 p.m. on the Friday before the election and before 5:00 p.m. on the Monday before the election that would prevent them from voting at the polls.  (Sec. 1, 3, 4)

2.       Stipulates that affidavits received to describe an emergency are not subject to statutes outlining the inspection of public records. (Sec. 1)

3.       Authorizes, for emergency balloting, the county recorder or other officer in charge of elections to allow a qualified elector to update their voter registration information as provided for in the Secretary of State's instructions and procedures manual. (Sec. 1, 2, 3)

4.       Allows the county Board of Supervisors (Board), on a specific resolution that is limited to a specific election date and that is voted on by a recorded vote, to authorize the county recorder or other officer in charge of elections to use emergency voting centers as prescribed in this Act. (Sec. 2)

5.       Requires the Board to specify the locations and hours of operation of the emergency voting centers. (Sec. 2)

6.       States that if the emergency voting center becomes unavailable and there is not sufficient time for the Board to approve a new location, the county recorder or other officer in charge of elections is authorized to make changes to the emergency voting location and is required to notify the public and the Board as soon as practicable. (Sec. 2)

7.       Stipulates that the new emergency voting center shall be as close in proximity to the approved emergency voting center location as possible. (Sec. 2)

8.       Allows qualified electors experiencing an emergency between 5:00 p.m. on the Friday preceding the election and 5:00 p.m. on the Monday preceding the election to vote an emergency ballot in the manner prescribed by the Board. (Sec. 3)
