Adds and modifies certain definitions
relating to manufactured housing.
History
A.R.S. § 41-4010 outlines the powers and duties of the Board of Manufactured Housing, which include:
1. Adopt rules imposing minimum construction requirements for factory-built buildings that are reasonably consistent with nationally recognized and accepted publications or generally accepted manufacturing practices.
2. Adopt rules relating to the inspection throughout the state by the Department of Housing of the installation of manufactured homes, mobile homes, factory-built buildings and accessory structures included as part of a sales contract.
3. Establish and maintain licensing standards and bonding requirements for all manufacturers of manufactured homes and factory-built buildings.
Current law requires a licensee, prior to installation of a factory-built building, who intends to accomplish the construction to submit to the Department of Housing detailed plans for each project for approval. Additionally, the Office of Manufactured Housing, or a 3rd-party who is authorized to verify compliance with the approved plans, must inspect the factory-built building (A.R.S. § 41-4005).
Provisions
1. Defines closed construction as any building, building component, assembly or system manufactured in such a manner that concealed parts or processes of manufacture cannot be inspected before installation at the building site without disassembly, damage or destruction.
2. Defines commercial as a building with a use-occupancy classification other than single-family dwelling.
3. Defines open construction as any building, building component, assembly or system manufactured in such a manner that all portions can be readily inspected at the building site without disassembly, damage or destruction.
4. Modifies the definition of factory-built building to mean, in part:
a. A residential or commercial building that is either wholly or in substantial part manufactured utilizing closed construction at an off-site location and transported for installation or completion, or both, on-site.
b. Does not include a manufactured home, recreational vehicle, panelized commercial building utilizing open construction, panelized residential building utilizing open or closed construction or domestic or light commercial storage building.
5. Defines residential as a building with a use-occupancy classification of a single-family dwelling or as governed by the international residential code.
6. Makes a conforming change.
