History

Current law provides the legislative per diem for a permanent resident of Maricopa County as $35 per day for subsistence during a regular or special session.  Each member who is a resident outside of Maricopa County receives an additional $25 per day as subsistence during a regular or special session.  If the regular session goes beyond the first 120 days, the per diem for Maricopa County residents drops to $10 and members outside of Maricopa County receive an additional $10 (A.R.S. 41-1104).

The federal per diem rate for Maricopa County is set by the United States General Services Administration.  The current annual average rate for Maricopa County is $129 per day (www.gsa.gov).

Provisions

1.       Establishes a long-term subsistence allowance for legislators in statute. (Sec. 1)

2.       Stipulates that, notwithstanding any other law, the maximum long-term subsistence allowance does not apply to legislators. (Sec. 1)

3.       Specifies that each member of the Legislature will be paid in an amount as determined by the director of the Arizona Department of Administration (ADOA) as follows:

a.       For a member who is a permanent resident within Maricopa County, 50% of the annual average federal per diem rate for Maricopa County as determined by the United States General Services Administration.

b.       For a member who is a permanent resident outside of Maricopa County, 100% of the annual average federal per diem rate for Maricopa County as determined by the United States General Services Administration. (Sec. 2)

4.       Declares that each member of the Legislature will be paid 50% of the amount determined annually by the director of ADOA for subsistence after the first 120 days of a regular session. (Sec. 2)
