Allows a licensed tobacco distributor to hold or store tobacco products in a residential location.
History
The Department of Revenue (DOR) administers tobacco distributor licenses, including basis for license denial, cancellation, revocation and suspension. Every person who acquires or possesses taxable tobacco products with the intent to sell or distribute the products must obtain a license from DOR.
As a condition of licensure, licensees agree to only hold or store tobacco products in a location that has been disclosed to DOR. This stipulation does not apply to a person who is holding or storing tobacco products on behalf a distributor when the products are in transit as part of a lawful sale. Current law prohibits the storage of tobacco products in a vehicle or residential location. It further states that any tobacco products stored or held must be accessible to DOR during normal business hours without a judicial warrant or the prior written consent of the distributor. Taxable tobacco products include cigarettes, cavendish, plug or twist tobacco, cigars, smoking tobacco, snuff, fine cut chewing tobacco, cut and granulated chewing tobacco, shorts and refuse of fine cut chewing tobacco, and refuse scraps, clippings and sweepings of tobacco. (A.R.S. § 42-3052)
