Appropriates $65 million to the State
Aviation Fund (Fund).
History
Laws 1995, Chapter 132 established the Fund, which consists of revenues from flight property taxes, aircraft registration fees, license taxes, fuel taxes, the sales of abandoned or seized aircrafts, investment earnings, and monies received by the Arizona Department of Transportation (ADOT) from the operation of airports.
ADOT distributes monies from the Fund for planning, design, development, acquisition of interests in land, construction and improvement of publicly owned and operated airport facilities in counties, incorporated municipalities and Indian reservations. No more than 10% of the average annual revenue that the Fund received for the past three years may be awarded to any one airport in grants in any fiscal year.
Publicly owned and operated airport facilities is an airport and appurtenant facilities in which one or more agencies, departments or instrumentalities of this state, or a city, town, or county of this state, or a tribal government holds an interest in the land on which the airport is located that is clear of any encumbrance that might preclude or interfere with possession, use, or control of the land for public airport purposes for a minimum period of twenty years (A.R.S. § 28-8202).
According to JLBC, the Fund had a balance of $6.6 million in FY 2017.
Provisions
1. Appropriates $65 million from the GF to the Fund in FY 2020.
a. Exempts the appropriation from lapsing.
