Prohibits the transfer of prepackaged binary
explosives to a minor and outlines civil penalties for violations.
History
The regulations in 27 Code of Federal Regulations part 555 (CFR) relate to commerce in explosives.
Explosives are defined as any chemical compound, mixture or device, where the primary or common purpose of which is to function by explosion.
According to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), binary explosives are pre-packaged products consisting of two separate components. The components are typically not listed separately on the list of explosive materials and do not meet the federal definition of explosives. The ATF does not regulate the sale and distribution of the component chemicals, even when sold together. When the components are combined, the mixture is then an explosive material subject to 27 CFR part 555.
Provisions
1. Prohibits prepackaged binary explosives from being sold, furnished, disposed of or given to a minor. (Sec. 1)
2. Prohibits a minor from buying, receiving or possessing a prepackaged binary explosive. (Sec. 1)
3. Requires a person to request identification with proof of age before conducting a transaction involving a prepackaged binary explosive. (Sec. 1)
4. Specifies that a person who sells, furnishes, disposes of or gives a minor a prepackaged binary explosive is subject to a civil penalty of $500. (Sec. 1)
5. Specifies that a minor who buys, receives or is in possession of a prepackaged binary explosive is subject to a civil penalty of $250. (Sec. 1)
