Requires the Arizona Department of
Transportation (ADOT) to consult with specified entities to develop policies relating
to authorized third parties and implementing electronic or digital records.
History
Pursuant to A.R.S. § 28-5101, ADOT is permitted to authorize third parties to perform certain functions that include: 1) title and registration; 2) motor carrier licensing and tax reporting; 3) dealer licensing; and 4) driver licensing. A.R.S § 28-5102 directs ADOT to: 1) supervise and regulate third parties required to obtain authorization; 2) establish minimum quality standards of service and a quality assurance program for authorized third parties to ensure compliance with minimum standards; and 3) adopt rules for administration and enforcement. Additionally, ADOT is permitted to: 1) conduct investigations and audits; 2) make on-site inspections; 3) require authorized third parties or their employees or agents to be certified; and 4) require authorized third parties or third party electronic service providers to reimburse ADOT for mutually agreed cost.
Laws 2018, Chapter 166, § 2 established that ADOT may implement electronic or digital versions of driver licenses, nonoperating identification licenses, vehicle registration cards, license plates or any other official ADOT record.
Provisions
1. Directs ADOT to develop policies relating to authorized third parties after consulting, at least 90 days before implementation, with representatives of:
a. An authorized third party; and
b. An authorized third party electronic service provider.
2. Specifies that ADOT must develop policies for implementing electronic or digital licenses, registration cards, plates or other official ADOT records after consulting, at least 90 days before implementation, with representatives of:
a. A law enforcement agency or political subdivision of Arizona;
b. An authorized third party; and
c. An authorized third party electronic service provider.
