Requires a municipality to print, on the
ballot, the party designation of all candidates for mayor or city or town
council.
History
The courts in Arizona have recognized that the Constitution of Arizona requires the Legislature's involvement in issues relating to elections conducted by charter cities. This includes laws relating to primary elections and voter registration laws to prevent abuse and fraud. Additionally, the Legislature declares that the conduct of municipal elections is of statewide concern.
Currently, a city or town may provide, by ordinance, that at the primary election any candidate for office of mayor or city council who receives a majority of the votes cast at the election is declared to be elected to that office for which the person is a candidate, effective as of the date of the general election. No further election for such candidate is necessary (A.R.S. §9-821.01).
Provisions
1. Stipulates that a city or town must print the party designation on the ballot of all candidates for the office of mayor or city or town council. (Sec. 1)
2. Removes current statute allowing a city or town to declare election winners based on the primary election. (Sec. 1)
