AN ACT

 

amending section 37-483, arizona revised statutes; appropriating monies; relating to land management.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 37-483, Arizona Revised Statutes, is amended to read:

START_STATUTE37-483.  Program to remove hazardous vegetative natural products; best land management practices; program termination; definition

A.  On or before January 1, 2018 2020, the commissioner and the state forester shall collaborate to establish a program to promote best land management practices to remove hazardous vegetative natural products from state trust land for the purposes of fire suppression and forest and watershed management on state lands and to facilitate the development of wood products industries in this state.  

b.  The program shall include a plan to coordinate with appropriate public agencies to remove hazardous vegetative natural products from federal and tribal lands for the purposes of protecting critical infrastructure or municipal water supplies.

B.  c.  To implement the program to remove hazardous vegetative natural products, the commissioner and or state forester may:

1.  Coordinate and contract with public agencies and private entities.

2.  Use programs that are designed to reduce parolee recidivism.

3.  Enter into an intergovernmental agreement pursuant to title 11, chapter 7, article 3 with a county, city, town, natural resource conservation district or other political subdivision public agency to share the cost of implementing the program removal of hazardous vegetative natural products.  An intergovernmental agreement entered into pursuant to this paragraph must state the responsibilities of each party with regard to implementing the program to remove removal of hazardous vegetative natural products from state trust, federal and tribal lands.

D.  any action under the program established pursuant to this section to remove hazardous vegetative natural products must be made in accordance with standards set by the national environmental policy act of 1969 (P.L. 91-190; 83 Stat. 852).

C.  E.  The program established pursuant to this section ends on July 1, 2027 2029 pursuant to section 41‑3102.

f.  For the purposes of this section, "public agency" has the same meaning prescribed in section 11-951.END_STATUTE

Sec. 2.  Appropriation; state forester; hazardous vegetation removal

The sum of $4,000,000 is appropriated from the state general fund in fiscal year 2019-2020 to the state forester for the purposes provided for in section 37-483, Arizona Revised Statutes, as amended by this act.
