FLOOR AMENDMENT EXPLANATION

 

1.    Expands the definition of primary care provider, as it relates to direct primary care agreements, to include licensed dentists, physicians who treat patients for chronic conditions and specified licensed physician assistants.

2.    Specifies that primary care services include:

a)    diagnosing, treating and managing acute and chronic conditions and other healthcare procedures on a routine basis; and

b)   dental services.

3.    Requires that a written notice of intent to terminate a direct primary care agreement be provided 30 days before termination.

4.    Modifies disclosure language that must be included with direct primary care agreement materials to specify that a provider is prohibited from billing health insurance for services provided under the agreement.

5.    Prohibits a direct primary care practice from charging different fees for comparable services based on the health status or gender of a patient.

6.    Permits a direct primary care provider to discontinue care for a patient if the practice changes the services or scope of practice provided to patients.

7.    Makes technical and conforming changes.
