AN ACT

 

amending title 33, chapter 16, article 1, Arizona Revised Statutes, by adding section 33‑1819; relating to planned communities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 33, chapter 16, article 1, Arizona Revised Statutes, is amended by adding section 33-1819, to read:

START_STATUTE33-1819.  Traffic enforcement; radar; calibration; notice; hearings

A.  An association may not use a Doppler radar unit or other speed enforcement tool to detect a violation of title 28, chapter 3, article 6 or of a city or town ordinance unless all of the following apply:

1.  The Doppler radar unit or other speed enforcement tool is properly calibrated by a licensed facility and the results are submitted to the Arizona peace officer standards and training board.

2.  The operator of the Doppler radar unit or other speed enforcement tool has at least ten hours of training on the proper use of the Doppler radar unit or other speed enforcement tool.

3.  The speed detected is at least ten miles per hour above the posted speed limit.

B.  An association shall provide at least as much notice and opportunity to be heard as is provided in section 33-1803. END_STATUTE
