1. Prohibits a merchant from offering a pre-complaint education program (program) to a person that has previously been convicted of shoplifting or offered an opportunity to participate in a program.

2. Requires a merchant to:

a) notify law enforcement that the merchant is offering a program;

b) coordinate with law enforcement and prosecutors regarding participation criteria and course content; and

c) facilitate data sharing with law enforcement to enable investigation and prosecution of criminal activity.

3. Designates course content information provided to law enforcement as confidential business information exempt from public records requests.

Between lines 4 and 5, insert:

"2. May not offer the program to a person who the merchant knows has previously been convicted of a violation of subsection A of this section or was previously offered an opportunity to participate in a precomplaint education program.

3. MUST PROVIDE OR REQUIRE THE INDEPENDENT EDUCATIONAL PROVIDER TO PROVIDE to LOCAL LAW ENFORCEMENT AGENCIES WRITTEN NOTICE THAT THE MERCHANT IS OFFERING A PRECOMPLAINT EDUCATION PROGRAM.

4. MUST COORDINATE WITH LOCAL LAW ENFORCEMENT AND PROSECUTORS AND on request PROVIDE INFORMATION REGARDING THE precomplaint EDUCATION PROGRAM, INCLUDING CRITERIA FOR PARTICIPATION AND COURSE CONTENT. ANY INFORMATION RECEIVED BY LAW ENFORCEMENT AND PROSECUTORS IS CONFIDENTIAL BUSINESS INFORMATION AND IS NOT A PUBLIC RECORD.

5. MUST FACILITATE DATA SHARING WITH LAW ENFORCEMENT TO assist THE INVESTIGATION AND PROSECUTION OF CRIMINAL ACTIVITY."
